It is the client's responsibility to read and understand the terms of service before the purchase of any artwork from the artist.
The artist will assume that the client has read the terms of service, and it is not the artist's responsibility to ensure that the client has done so.
Any breach of the terms of service may result in the termination of a commission or a refusal to work with the client.
The artist reserves the right to refuse or refund a commission at any time with or without explanation.
Issues should be brought up directly with the artist if the client wishes for them to be addressed.
Arrangements can only be made if the artist is contacted privately and directly.
By default, the artist will be awarded the following permissions regarding commissioned work.
If the client would like to request any changes to these permissions, please make sure it is done prior to the commission's start:
The artist has the right to post WIPs, both publicly and privately, of commissioned work.
The artist has the right to stream or broadcast the process of the commission, either live or recorded.
The artist has the right to post the commissioned artwork to their socials and use it to promote their work and services.
The artist will provide an estimated turnaround time based on the scope of the commission.
Average turnaround times range from 1 week to 3 months.
Turn-around times may vary, and the artist will always endeavor to inform the client about longer-than-average wait times.
The client maintains the right to receive updates about the artist’s progress at any given time.
Please always give up to 48 hours for a response.
WIPs (work in progress images) are sent per client request.
WIPs will typically be sent to the client at regular intervals, depending on the scope of the order.
The default intervals will be at the sketch stage, at the line-art stage, and the color stage, but this will not be the same for every commission.
The client may request to see additional WIPs if they believe it is necessary.
Large Edit Fees
The main purpose of WIPs being sent to the client is so the client can make sure that their commission is progressing as planned. The client is encouraged to point out any flaws or mistakes as early as possible, as extra fees may be incurred if major edits are required at later stages of the commission.
Large edits can be made at any stage of the process, but as stated above, large edits that are not due to the fault of the artist will incur additional fees.
What constitutes as a Large Edit?
A large edit is any edit that requires the artist to completely change a commissioned work almost from the ground up, this will include things such as:
Requesting a character change after the commission has already started.
Requesting large changes to colors, expression, and/or pose when the commission has already progressed beyond the coloring phase.
Requesting that a commission be redone.
This section will outline what ownership a client will have over any given artwork by default.
A contract will be written if different agreements are made that do not align with the default rights listed below.
The client will NOT be allowed to:
Refuse to give credit to the artist.
Claim artwork as their own work.
Use commissioned work in an offensive manner, or with the intention to hurt others.
Disregard the agreed-upon requests made by the artist regarding their work.
Resell artwork or designs for a higher price than it was purchased for without extra material.
Use commissioned artwork to train AI in any way.
The client may negotiate these topics with the artist:
Claiming full copyright of an artwork.
Using commissioned artwork to gain direct or indirect profit.
Making modifications to the commissioned artwork, either directly by the client or through a third party.
Keeping their commission private (the artist will not upload the commission publicly or show it to anyone else).
The client will always have the right to:
Repost a commissioned piece, provided that credit is given.
Use commissioned artwork for non-monetary projects.
Resell commissioned work for its purchase price.
Please contact the artist ahead of time if you wish to negotiate different rights of ownership.
If the artist finds that a client fits into any of the below criteria during or before an order is placed, the commission will be canceled and a refund will be given based on the amount of work left on the commission.
The artist will not accept commissions from a client who falls into any of the following criteria:
Anyone who is found to be racist, homophobic, transphobic, ableist, antisemitic, a zionist, a zoophile, a pedophile, a perpetrator of sexual assault, and/or anyone who supports these beliefs in any manner.
Anyone who provides AI art as a reference image and/or promotes the use of AI art.
Anyone who intends to use commissioned art to assist with AI generation (the artist will, under no terms, agree to allow their art to be used for AI image generation).
The artist reserves the right to cancel a commission at any time for whatever reason.If the above criteria do not factor into the commission's cancellation,
the client may be entitled to a full or partial refund depending on the circumstances.
Any refunds that need to be issued due to the fault of the artist will always be refunded in full and immediately.
Please contact the artist as soon as possible if you feel as though you may need a refund!
Refunds can be requested at any time, however full refunds are only issued before the commission has been started.
What if the order has already been started?
If a commission has been started, it may not be possible for the artist to offer a full refund. The amount that can be refunded will be proportional to how much progress has been made on the commission.The unfinished commission will still be delivered to the client but no further work will be done on the artwork.
Forced Refunds
If a commission must be canceled due to misconduct on the behalf of the client, the commission will be cancelled, and a refund will be issued proportionally to how much progress has been made on the commission.Delivery of files and artwork may not be provided if this is the case.
